During our initial consultation, we will discuss and walk through the differences between wills and trusts. Once we have had this discussion, the vast majority of our clients choose to create a trust-based plan. There are many reasons for this. A properly designed and implemented trust-based plan ensures that the probate court will not get involved in making decisions for you and your family in the event of your incapacity or death. By using a trust, you (not the Court) dictate who makes financial decisions for you and your family in the event of your incapacity or death. In a trust plan, you (not the Court) determine who receives assets, and you have the ability to provide detailed instructions and guidelines as to how those protected assets are distributed to your beneficiaries. A properly designed and implemented trust plan avoids the probate process, and protects your family from the frustration, delay and expense of probate court proceedings.
